SUBLETTE COUNTY – Noting that chances of a settlement are “poor” for a lawsuit filed by a former Daniel man against investigators after his two murder trials, a federal magistrate set a bench trial date of Dec. 2 in Casper.
Montana resident Troy D. Willoughby, convicted of first-degree murder by a Sublette County jury in 2010, sentenced to life in prison and then acquitted by a Fremont County jury in a new trial in 2011, filed a lawsuit in U.S. District Court on Sept. 17, 2012.
In the filing, Willoughby alleged that three Sublette County investigators – Deputy Sarah Brew, then-Capt. Brian Ketterhagen and county attorney’s office investigator Randall Hanson – deliberately withheld potential exculpatory evidence from his defense team and violated his constitutional rights by imprisoning him before, during and after his first trial.
